Recognized as one of Canada’s leading competition law practices by Global Competition Review’s GCR 100 and other peer review surveys, Heenan Blaikie’s Competition/Antitrust and Foreign Investment group provides advice and representation to international and domestic clients on all aspects of Canadian competition, foreign investment and regulatory law. Our advocacy-driven approach to our practice differentiates us from our competitors. Our practice includes merger clearance, criminal and civil contentious work (including cartel investigations and class action defence) and compliance advice on distribution, pricing and marketing/advertising matters. We also provide market leading advice on foreign investment regulation.

A distinctive feature of our expertise is our recognized ability and reputation in criminal and quasi-criminal matters, including defending criminal and regulatory investigations. In addition, our practice is distinguished by the presence of lawyers with high-level federal and international experience in public policy.

Our industry experience is comprehensive, and we routinely advise clients in highly regulated sectors, such as:

  • media and entertainment
  • energy
  • transportation
  • mining
  • financial services
  • pharmaceuticals

Services Overview

  • Mergers – Wehave advised clients regarding Canadian merger clearance and foreign investment reviews in complex transactions, often with a multi-jurisdictional dimension.
  • Foreign Investment Review – Canada’s foreign investment regime requires government review of certain investments into Canada, including transactions exceeding certain thresholds and the establishment of new Canadian businesses by foreign investors. We have exceptionally strong experience in this area and have successfully advised foreign investors in some of the most contentious cases in the history of Canadian foreign investment review.
  • Contentious Work – Our group combines a deep substantive knowledge of competition law with leading courtroom advocacy. We regularly act for clients facing contentious competition law issues, including international cartel investigations and civil class actions.
  • Compliance/Distribution Practices – Incorporating the ever-evolving nature of Canadian regulatory requirements into day-to-day business activities can be a daunting task. Heenan Blaikie advises its clients with regulatory compliance with a sensitivity to business realities. Our advice has helped many businesses in heavily regulated industries to comply and succeed.
